§ 4-207. Penalty for failure to comply with an order from the city council of the city of gulfport.

  • In the event that the code enforcement office, after that thirty (30) day notice period, find and determine that the premises have not been so fully abated of all violations, the owner, occupant, or person(s) in charge shall be charged with a misdemeanor under this ordinance, with each day after any order of violation upon which a nuisance continues deemed a separate misdemeanor violation. Upon such a charge, the owner, occupant, or person(s) shall be tried for a misdemeanor under this ordinance for each day of the charged continuing violation, with each day a separate misdemeanor charge. A finding of guilt for any such misdemeanor for a continuing violation shall be punished for each daily occurrence up to the maximum allowed by law. Upon conviction, the owner, occupant, or person(s) found guilty shall again be ordered to fully abate the nuisance. If the nuisance is not abated within thirty (30) days the City of Gulfport will abate the nuisance and will levy the cost to the property's tax for the coming year.
