§ 1-228. Municipal judges.

  • (a)

    Appointments. A municipal judge with full-time employee status shall be appointed by the governing authority and be subject to removal from office in the manner provided for directors or department heads of the municipality. Additional full-time judges may be appointed if required by the business of the municipal court. If more than one (1) full-time judge is appointed, each judge shall have the same functions, duties, powers and responsibilities, except that only one (1) judge shall be designated by the governing authority as chief judge of the court.

    (b)

    Assistant or pro-tempore judges. In addition to one (1) or more full-time judges, the governing authority as provided by law shall appoint such additional judge or judges to serve as assistant or pro-tempore judge as may be required by the business of the court. The assistant or pro-tempore judge shall hear such cases and handle such business of the court as may be assigned by the chief judge, or as may be required by absence or conflict of interest of the full-time judges. If the caseload or business of the court requires the holding of court or administration of business by the court by the assistant or pro-tempore judge simultaneously with that of the full-time judge or judges, then the assistant or pro-tempore judge shall be deemed to be serving in the place of and with the same power and authority as the chief or other full-time municipal judge.

    (c)

    Powers, duties and qualifications of municipal judges. The municipal judges of the city shall be licensed attorneys in the state and shall qualify as other employees to work for the city, and shall be vested with the same powers and perform the duties provided for municipal judges in the state (MCA 1972 § 21-23-7 et seq. as amended, and related laws).

    (d)

    Court rules. The chief judge of the court shall have the power to make rules for the administration of the Court's business, to be in writing filed with the clerk of the court, and the rules of court shall be furnished to and followed by all other judges of the municipal court, prosecuting attorneys and other court personnel and officers of the court as may be directed by the judge.
